Retired Supreme Court justice will hear Jameis Winston's Code of Conduct hearing

Florida State is using a retired state Supreme Court justice to preside over the Student Code of Conduct hearing involving star quarterback Jameis Winston, according to the Tallahassee Democrat.

Three retired justices will be available for the sexual assault hearing, Mary Coburn, vice president of student affairs, told the paper. Winston and his accuser each are allowed to eliminate one justice. If they both choose the same justice, Florida State will choose from the remaining two.

The identity of the justice will be revealed when Winston appears for an information session regarding the alleged Student Code of Conduct violations later this week.

Winston and his attorney were informed Friday in a letter by Florida State interim president Garnett Stokes and Coburn that Winston “might be charged with one of four violations of FSU’s student conduct code regarding sexual conduct.” Winston and his attorney had five days to schedule an information hearing.

During that hearing, Winston will be presented with his rights and learn more about the conduct hearing. The conduct hearing will be held as soon as soon as possible after the informational hearing. That hearing will determine whether Winston will be charged with violating the school’s code of conduct.

State Attorney Willie Meggs ruled last year that there was insufficient evidence to press charges against Winston in an alleged sexual misconduct investigation involving a former female student in December 2012. The alleged victim said Winston raped her and filed a complaint with the federal Department of Education, which prompted a Title IX investigation.

Winston led the Seminoles to an undefeated season last year, a national title and won the Heisman Trophy. Florida State is 6-0 this year and Winston has started every game except against Clemson when he was suspended for yelling an obscene phrase in the student union.
