Last Vanderbilt rape suspect avoids prison after plea deal, testifying against fellow defendants
The fourth defendant in a 2013 rape case that involved Vanderbilt football players and an unconscious female student found out his fate on Monday.
Jaborian “Tip” McKenzie received a 10-year suspended sentence and 10 years of supervised probation after pleading guilty to one count of facilitation of aggravated rape. He will be on the sexual offender registry for the rest of his life. He will not serve prison time.
Jaborian McKenzie faced seven charges before his plea deal
McKenzie was originally charged with five counts of aggravated rape and two counts of aggravated sexual battery. He stood accused of helping three other Vanderbilt football players carry their victim into a dorm room where Brandon Banks, 24, Cory Batey, 24, and Brandon Vandenburg, 24 were convicted of assaulting her while McKenzie stood by.
The attackers took cell phone video and photos of the incident. McKenzie was not seen touching the victim. He testified against the other three defendants.
Other defendants facing lengthy prison time
Banks and Batey received 15-year prison sentences while Vandenburg, who was dating the victim and found to have orchestrated the crime, received a 17-year sentence.
Vandenburg met the woman at a bar the night of the crime where she said she did not remember what happened between having a drink and waking up in Vandenburg’s dorm room the next day in pain.
Testimony reported by the Tennessean during Vandenburg’s 2016 trial described the crime.
Vandenburg carried her unconscious body into his room at Gillette Hall about 2:30 a.m. June 23, 2013, asking three teammates he ran into outside for help. They put her on the floor and at least two of them penetrated her with their fingers and one sat on her face, raising his middle finger for a photograph, according to trial testimony.
Vandenburg could not get an erection, so he watched pornography on his laptop.
He tried to wake up his roommate on the top bunk, saying “we have this b—- in here” and “we’re gonna f— her.”
Jaborian McKenzie approached prosecution prior to charges being filed
Deputy District Attorney Roger Moore told USA Today that McKenzie approached prosecutors in 2013 before charges were filed and that his testimony was key to the case.
“In any case, cooperation is something that is going to be taken into consideration,” Moore said. “His cooperation spanned literally almost five years.”
