Special prosecutor ordered in Ark. rape claim

LITTLE ROCK, Ark. (AP)—A special prosecutor will review a rape claim against three Arkansas basketball players after local authorities declined to file charges.

Washington County Circuit Judge William A. Storey filed an order Monday asking the state’s prosecutor coordinator to recommend someone to take over the case. A lawyer representing the accuser requested a special prosecutor last week, and local prosecutor John Threet filed his own motion Monday asking for one.

“While I stand by the decision that there is insufficient evidence to file charges against any of the young men, I have requested and received an order appointing a special prosecutor,” Threet said in a statement. “The complaining witness’ private attorney has questioned the ethics and integrity of this office. This office does not take such accusations lightly.”

John D. Bass, who represents the accuser, noted in last week’s brief that Threet is the son-in-law of former Arkansas athletic director Frank Broyles, and the brother-in-law of an athletic department spokesman.

A university freshman named three basketball players in the complaint, saying she was raped at a fraternity house in late August. Threet announced in September he wouldn’t bring charges.

Bass said Monday’s order would save time and expense.

“The victim and her family are hopeful that a thorough and unbiased investigation will be conducted and we will be concentrating our efforts on that,” Bass said in a statement.

Threet said he wanted to speed up the process of appointing a special prosecutor because “this needs to be an end to this.”

“I have stated from the beginning that I am not opposed to the court appointing a special prosecutor,” Threet said. “If I can do anything that speeds this process along for the sake of all of the young people involved, I will do it.”

I guess going into a fraternity house and putting yourself "alone" in a room with 3 men is totally normal behavior for a female.

The only reason you hear about white girls with these problems is because black girls think it is normal to have 3 or more guys forcing themselves on them. Any man who thinks it is ok to take what they want from a woman whether she is drunk, high or whatever is S**t in my eyes. These "college B-ball players" should of been smart enough not to put themselves in the position in the first place. Comments on this thread make me understand why race is still an issue in the south. OOPS I'm late for our local klan meeting! Grow up people!!!!!!

Rico, you said you "went to school"??? I would really suggest you demand your money back. Just show them your posts and they will realize you have an ironclad case and would gladly give it back. Of course you would have to agree to NEVER specifically identify them as the school you went to.

Ok, just want to clear up some of the nonsense being spouted in here. I'm from Fayetteville and have followed this story closely. Of the three players under suspicion in this case, two are black and one is white. The girl is white. So we have a mixed race situation. Therefore racism from either direction is misplaced. This isn't about skin color, this is about what happens when ignorant sorority girls let themselves get into bad situations with people they hardly know. Something that happens on every campus in the world. Wherever you are from, I challenge you to look into the statistics related to rapes on any campus you can think of. It happens constantly, and none of you care about it until it involves an athlete. Maybe, since none of us know the facts bout this case, we should just shut up and wait to see how it turns out. And as for you people who seem to think that this is only a sports problem, do you have any idea how many frat boys get away with rape all across the country every single year? It would make you sick to your stomach. J.C. people, I'm from Arkansas, I'm supposed to be the ignorant one. I see alot of naive people talking about things they know nothing about on this thread.

Racism exist in every state, in every city, in every town and on every block. It's not an Arkansas thing, it's not a southern thing and it's not unique to just the United States. It amazes me how so many of these post see color first and foremost. Being from Arkansas but having not lived there since 1983, I have the distinctive pleasure of seeing MY home state from the outside looking in. Before I left, the state motto was "Thank God For Mississippi" otherwise we would have been at the very bottom. I have seen some great progress over the years and especially the last to to 12 and Arkansas is no longer or near the bottom of every catagory. This includes public displays of racism or racism being taught in the home as a way of life.

Everyone is innocent until proven guilty regardless.

Jim M, God Bless Europe? I've been there and lived there, have you? If you like it there so much, move there, otherwise work towards making the country you do live in a better place for all mankind.

Jim M. #38. You are absolutely right. Most could not pass classes without "tudors" (sic). Maybe you should get one. It seems you were intimately involved in the investigation (I'm assuming what you wrote is factual, hence involvement, not just some ignorant rant).

Remember the Duke lacrosse case a few years ago. Jackson, Sharpton all holding rallies, protests, boycots, political, corporate and university pressure, and of course showed up wherever there were TV cameras, declaring they would never rest until those rich white preppy privleged Duke students were brought to justice. Seems they decided the rape charge was a fact and that because they were athletes, rich white preppy ones at that, justice REQUIRED their presence and wisdom and declarations of guilt. Hummmm, seems they might have gotten that one wrong. Of course I've while they were in front of the TV cameras for months and months, when the truth came out, amazingly they were nowhere to be found. Never did hear of them coming out and admitting there error.

What you wrote sounds pretty darn familiar. Have you been consulting with Jackson and Sharpton? Seems, like them, you have the investigation, trial and judgement under control. Privleged athletes in a southern school. Your right, they are absolutely guilty as hell. No doubt. Just ask the Duke lacrosse players.

its sad to say this but athletes period all over the usa go through this, the media blows it up and we have unjust ideas, trust me on this ifas there was any foul play mr. threat would have put those kids in jail.arkansas is a great place to live, and being in fayetteville is a dream for some people.its true arkansas people have a long way to go,and until certain people make changes our great and well respected program will be trouble years to come.and as for the girl in this, she aint' the first one to lie on athletes and she won't be the last,so my suggestion is stay away from the university parties if you feel there is a problem, and when is the last time somebody got killed on campus,so you guys just full of it and keep dum @#$% going, whoever said that dum @#$% about lawyers.

I am from Arkansas, there can be racism but for the most part it's a great state. My concern is why are college students focusing on alcohol, drugs and sex? When they should be studying and trying to better themselves. This speaks VOLUMES on their parents, role models and society as a whole. GROW UP PEOPLE! Get grown before you make irrational decisions.

The level of racism in this country never ceases to amaze me. Some of these idiot think they can come to a forum like this and spew their hate because they hide behind a computer screen.
Doesn't matter the color of anyone involved, if there was a crime whether black or white, they should be in jail. If she was lying then she should be in jail. We normal hard working people of the country would sit and rot in jail until we were proven innocent.

HERE COMES THE TRUTH OF MATTER

I will make a strong comment... first, most of the comments i have read is Bull@#$%...
    1. student athletes...hello... without tudors doubt many of them could pass classes.
    2. Arkansas is a racist state... that is a fact... Coach Richardson knew it from the get go
    and the @#$%s got him....
    3. Even without all the facts... and waiting on things to play out... the gal got screw again..
franklly, i think she was rape.;.. but good old boys protect the players...happens all the
time as U of A... nothing new at all.... don't be naive...
    4. Yes, Arkansas is a poor state...always has been...mabye not number 50 ...but it is poor.
    5. Justice in Arkansas is controlled by about 15 families... they control everything in the state...
insiders know it... bubba bill knew it... so keep this group happy no problem.....
    6. I enjoy sports... like basketball very much... but I think we have lost respect for rule of law when
it comes to athletes... and the foolishness from administration at Arkansas is a joke... even a common
fool knows it... will real student/ath ever return to college sports...easy answer .... Nope!

Folks,,, this is just the way of life in this southern state... like it or not... this is just the way it is even
in 2009.... now that comes from an american retiree that grew up in the state and now lucky enough to
said.... I am from Arkieland... God bless Europe... America is going to pot smoking liberals... and stupid politicans like the S.C. governor... America better wake up....

    Mr. Common Sense,
There is poverty everywhere. Can the superior attitude, because I doubt you're superior to anyone. You probably don't even have a family.
