    Instant analysis: Nick Diaz’s positive test, what should happen next?

    It's not the first time Nick Diaz and a state commission have battled over his marijuana use, but this time it could be a trend setter.

    Yahoo! Sports' Kevin Iole broke the story that Diaz tested positive after his fight at UFC 143. If his penalty mirrors the one boxer Matt Vanda got last week from the NSAC, then Diaz will be fined $80,000 and be given a one-year suspension.

    Is that fair? Should a violation for a marijuana test be the same as steroids? Iole reacted just minutes after the story broke on Las Vegas' ESPN1100/98.9 FM.

    UFC president Dana White released a statement on the Diaz slip:

    "I am beyond disappointed that he tested positive for marijuana," White said in the statement that the UFC distributed to the media. "It is now in the hands of the Nevada State Athletic Commission."

      Nick Diaz is a professional fighter, not to mention a grown man. He knew the risk he was taking, when he hit the weed. He knew the rules when he signed his UFC contract, but chose to break them anyway. Apparently, getting high was more important than getting paid, for him. If you do the crime, you have to do the time...period. Now he has an entire year to sit back & smoke all he wants.

      the issue isn't whether it hurts or helps, or whether is should be legal. the issue is that is the rule and he knew it going in to it. and if he wants to toke up for whatever reason in spite of the rule, whethere it is right or wrong, and he gets whacked for it i guess he will have to just man up and take the consequences.

      Good grief, what would the Diaz brothers be like if they DIDN'T smoke weed? Isn't it supposed to make you mellow? I'd argue Nick's not smoking enough. lol But in all seriousness, a rule is a rule and it's not like this one hasn't gotten him in trouble before. A medical marijuana card is not an excuse, it's a joke since he doesn't have any illness that would warrant having one. Oh, and it's still a Federal Crime, so when it happens across state lines it becomes even more of a crime and all that.

      In short, it was a dumb thing to do.

        Having pot in your system isnt a federal crime but posessing it is. Im not sure in Nev anymore but i know at one point even if all you had was a seed or even a tiny leaf it was a felony but having thc in your system wasnt. What about marinol(SP?) Can that be prescibed normaly or is that a felony as well thats if the feds wanted to nail you? an old roomate i had in CA had his medical card because he has Chrons disease but he also had a marinol precription.

      The issue isn't if you think weed helps or hurts a fighter. The issue isn't why Diaz smokes weed. The issue isn't if you think it should or should not be legal.

      The issue is that it is not allowed by the NSAC. Nick Diaz knows this since he has failed a previous test and refused another in California while at Strikeforce. Nick knew he was going to get tested. He knew he couldn't do it and he did anyway.

      As a weed smoker myself I can only conclude he did this on purpose. Passing a urine test is a simple thing to do. Diaz was looking for an excuse. He was looking for a way out. It's just more self destructive behavior. Like skipping out on press conferences or running out the backdoor to avoid his trainer. Diaz is a headcase. A talented fighter, but a headcase.

      You can't argue that it's unfair. Everybody plays by the same rules. You can't even argue if it's right or wrong, he knew the rules. He made a decision to break a rule and not even try to cover it up. There is no rational position in his favor.

        Well said Jimbo. I don't discount your theory of self-destructive behavior, conscious or otherwise, but I think it is more about his lack of maturity and self-discipline. It's counterintuitive that someone who is such a great athlete could lack self-discipline. However, when you love working out it doesn't take much self-discipline to do so. He probably loves pushing himself. But it's doing the things in life that you don't want to do that require discipline and maturity. Maybe he screwed up in his cleansing, or just couldn't handle the pressure and had a few hits to calm down even after he knew he shouldn't. IDK, but there is no question that Diaz, and only Diaz, is responsible.

      So you can get prescribed Testosterone by your doctor and fight in the UFC, but if a doctor prescribes you the sticky-icky you can't fight in the UFC????

        I think every state has different rules about these things, but Nevada is considered the measuring stick with New Jersey cause they are fight capitals( i think). I am pretty sure they could get him sanctioned in another state if they realy want to we will see.

      Diaz is highly talented, thing is, he has a problem that some talented people do, he sabotages himself, every time he gets close to the top, he pulls this.

      I am an EX-pert in THC and let me tell you who have never used it. It can help when you are in a fight. No1 it helps relax the muscles and make you have fun when breaking someones face. I have used it to ease body aches BOY-o-Boy works good at it. I took a puff before I typed this and as you can see I am doing a mighty fine job even tho my mind thinks I am with Nick right now and he is telling me what to say. I quit the world of MMA he just said and that he might open his own THC shop to help people since he is an EX-Pert also in THC. So there are the many facts now that will make your head spin right off and fall in to your lap and don't do what you are thinking with your mouths since your head is near your fun spots.

      I am not for or against the use of marijuana, but if it is against the rules then you simply should not do it. He should be punished. I'm disappointed because I enjoy watching him fight, but I'm not shocked and anyone who ever listens to the guy talk and pays attention to his actions realizes he marches to the beat of his own drum. This news is not shocking, just disappointing.

      Nick is an all natural guy...it's not a joke. He is a vegan or vegetarian..whichever. He obviously has problems that doctors would love to treat with pharma meds. He doesn't want that crap, so he smokes pot. The 'natural' anti-anxiety drug. (Yeah, I'm assuming some here)

      Anyway - as long as it is a banned substance per the rules, then nobody can argue his fine and suspension. You can argue that pot should be legal, sure...but can't argue the current punishment. Nick needed to make different choices if he didn't want to end up here. I don't recommend the pharma drugs, but sometimes sacrifices have to be made.

      A lot of haters will think that Nick is just a pot head. I don't believe that. How many pot heads do you know that run triathalons and train all the time? I believe Nick uses it in a medicinal way. But like I said previously, doesn't mean he should not be punished.
